This End User License Agreement ("EULA" or "Terms") governs your use of the ValenciaLink mobile application (the "App"), operated by ValenciaLink ("we", "us" or "our"). By downloading, installing or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 16 years old to use the App. By using the App you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use the App on devices that you own or control, strictly in accordance with these Terms and the usage rules set forth in the Apple Media Services Terms and Conditions.
3. Description of the App
The ValenciaLink App provides:
- Curated directory of places, businesses and services in Valencia, Spain.
- Editorial content including articles, guides, reviews and multimedia.
- Interactive map with neighbourhood data, property prices and liveability ratings.
- Event listings and cultural calendar.
- Real estate listings and insurance comparison tools.
- Mobile-optimised access to ValenciaLink services with offline capabilities.
4. ValenciaLink PRO Subscription
The App offers an optional auto-renewable subscription called ValenciaLink PRO that provides access to premium features.
4.1 Subscription Plans
ValenciaLink PRO is available in the following plans:
- Monthly: billed once per month.
- Yearly: billed once per year.
Current prices for each plan are displayed on the subscription screen within the App prior to purchase. Prices may vary by region and are subject to change.
4.2 Payment and Billing
- Payment will be charged to your Apple ID account at the confirmation of purchase.
- The subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan.
- Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.
4.3 Managing and Cancelling Subscriptions
You can manage or cancel your subscription at any time through your Apple ID Account Settings:
Settings > [Your Name] > Subscriptions
Cancellation takes effect at the end of the current billing period. You will retain access to PRO features until the end of the period you have already paid for. No refunds will be provided for any unused portion of the current billing period.
4.4 Free Trials
We may offer free trial periods for ValenciaLink PRO. If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends.
5. User Accounts
Certain features may require account creation. You agree to provide accurate, complete and current information and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
6. Acceptable Use
You agree to use the App only for lawful purposes and in compliance with these Terms. You shall not:
- Attempt to gain unauthorised access to any part of the App, other accounts or connected systems.
- Use the App to transmit spam, malware, or any unsolicited communications.
- Reverse engineer, decompile, disassemble or attempt to derive the source code of the App.
- Copy, modify, distribute or create derivative works based on the App.
- Use the App in any way that could damage, disable, overburden or impair our servers or networks.
- Upload content that is illegal, defamatory, obscene, infringing or otherwise objectionable.
7. Intellectual Property
All content, design, graphics, branding, logos, text, photographs, videos, software, code and the compilation thereof are the property of ValenciaLink or its licensors and are protected by copyright, trademark and other intellectual property laws of Spain, the European Union and international treaties.
8. User-Submitted Content
By submitting content to the App (reviews, photos, messages), you:
- Confirm that you own or have the necessary rights to share such content.
- Grant ValenciaLink a non-exclusive, worldwide, royalty-free, transferable licence to use, reproduce, modify, publish, distribute and display the content in connection with the App and the Service.
- Acknowledge that we may remove user-submitted content at our discretion.
9. Third-Party Services
The App may contain links to or integrate third-party services. We do not control, endorse or assume responsibility for the content, privacy policies or practices of any third-party service. Your interactions with third parties are governed by their own terms.
10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by applicable law, ValenciaLink shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, use, goodwill or other intangible losses, resulting from your access to or use of (or inability to access or use) the App.
Our total aggregate liability shall not exceed the greater of €100 or the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend and hold harmless ValenciaLink from and against any claims, liabilities, damages, losses and expenses arising out of your access to or use of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Suspension and Termination
We may suspend or terminate your access to the App at any time if we reasonably believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Active subscriptions are managed through your Apple ID and are subject to Apple's cancellation and refund policies.
14. Changes to the Terms
We reserve the right to modify these Terms at any time. Updated versions will be posted on this page with the "Last updated" date revised accordingly. Continued use of the App after such changes constitutes acceptance of the modified Terms.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain, without prejudice to mandatory consumer protection rules of your country of residence where applicable under EU law.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
